What about a duty of care for your model?

Currently, there is no specific duty of care for software or models. Producers therefore do not have to prove that they did nothing wrong. However, the Dutch legislator (and other European legislators) will soon have to implement the Directive (EU) 2019/770 (the Digital Content Directive). This directive makes the trader of digital services or content liable for a failure to deliver the digital product and for some forms of non-conformity. This extends a part of the current product liability regime to digital products. The European Commission's proposal of the AI Act [link] may also change the liability of producers and traders of software and models.
